Ask the Wine GeekQ: Can't you return a defective bottle of wine? I opened a bottle that tasted badly corked, so I closed it up and brought it back to Costco, where I bought it. They refused to replace it, and pointed to a large sign saying state law prohibited them from giving me an exchange or refund.  Is that true?

A: No, it's not true. It's the store's choice whether to take back a bad bottle -- just as it's your choice whether you want to buy your wine from a retailer who won't.

Admittedly, lots of people -- even some retailers -- are confused about this. The reason is simple: under normal circumstances, you can't take back any alcoholic beverages for refund or exchange. You buy it, you own it. That's Michigan law.

But there's an exception. I call it Catch 31 -- otherwise known as Rule 31, Section 436.1531 of the state Liquor Control Commission's regulations. It says that an off-premises licensee (that's a retailer to us non-lawyers) may take back an alcoholic beverage that is "demonstrably spoiled or damaged" for exchange or a refund. That law took effect back in 2000.

Notice the word "MAY". That gives the retailer some wiggle room -- the state doesn't require them to take back bad bottles, but they can if they want to. Of course, a retail store that doesn't accept defective returns may decide to pass the buck and blame state law instead of their own consumer-unfriendly policy, figuring that most customers don't know any better.

This is very interesting. I read this comment then went to Costco today. The sign on the wall states that the Michigan law states that it's against the law to return ANY alcoholic beverage. So the watchword here is ANY and clearly they are wrong. Now, who is going to contact Costco?

Actually, Costco has replaced a bottle of corked wine for us last year. My wife had to meet the distrubutor in a parking lot and they exchanged the bottles. You have to be persistent and a corked bottle of wine is clearly a damaged bottle and seems to meet the spirti of Rule 31.

That's good to know. My husband took back a corked bottle to the Costco on Stephenson Highway a few years ago and they refused to refund or exchange the bottle and simply pointed to the sign.

I don't know about Costco since I don't buy there, but in Grand Rapids, Russo's has never refused to take back a bottle of corked wine - even if purchased several years before. I either get a new bottle of the same wine, or credit for what I paid for it (if the sticker is still on it) or for the lowest selling price of that wine (if I have removed the sticker, which I don't do anyomore.) It is great to do business with Russo's.

Hi im going on vacation to Germany and staying at friends house> I want to take some Michigan wine so that they can tast Michigans wines. I myself dont drink wine I haver never found a wind that I just love. What wite would recommend taking for a gift??
